Colourity Terms of Service

Welcome to Colourity! These Terms of Service ("Terms") govern your access to and use of the Colourity mobile application (the "App"), our website, and any related services (collectively, the "Service").
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By downloading, installing, or using the Service, you signify your agreement to these Terms. We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the new Terms.
2. Description of Service
Colourity provides a mobile application designed to analyze a user's personal color palette from a photo. The Service helps users build a digital wardrobe by cataloging garment photos and recommends outfit combinations. In addition, the App may suggest wardrobe additions and provide shopping recommendations linked to third-party retailers (such as Myntra, Amazon India, and Flipkart) when items from the user's own wardrobe do not match the recommendation.
3. Eligibility
You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
4. Accounts
To use the core features of the Service, you must sign in with a valid Google account. Colourity does not support anonymous or guest accounts. You are solely responsible for maintaining the confidentiality and security of your account credentials, and you agree to accept responsibility for all activities that occur under your account.
5. User Content
You retain full ownership of any photos or other content you upload to the Service. By uploading photos (including face scans and garment photos), you grant Colourity a limited, non-exclusive, royalty-free, worldwide license to process, store, and analyze those images (using Colourity AI) solely for the purpose of providing color analysis and wardrobe cataloging features to you. We do not sell your photos or personal data to third parties.
6. Purchases and Credits
Colourity offers credit packs for purchase via Google Play Billing. These purchases are one-time, non-recurring transactions and are not subscriptions. Credits are used within the App to perform face/color scans and garment scans (each scan consumes a fixed amount of credits). All credit pack purchases are final and non-refundable, except as required by applicable law or the refund policies of Google Play. Unused credits do not expire and remain valid indefinitely.
7. Third-Party Links
The Service may contain links to third-party websites or services (including, but not limited to, Myntra, Amazon, and Flipkart) that are not owned or controlled by Colourity. Colourity has no control over, and assumes no responsibility for, the content, privacy policies, pricing, availability, or practices of any third-party websites. You acknowledge and agree that Colourity is not liable for any damage or loss caused by your use of third-party sites.
8. Prohibited Conduct
You agree not to misuse the Service. Specifically, you agree not to:
- Attempt to reverse-engineer, decompile, disassemble, or extract source code from the App.
- Upload content that violates or infringes the intellectual property rights, privacy rights, or other rights of any third party.
- Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international laws.
- Interfere with, damage, or disrupt the operation of the Service, or attempt to gain unauthorized access to our servers or databases.
9. Intellectual Property
The Colourity name, logo, wordmark, app design, graphics, and all software and technology associated with the Service are the exclusive property of Colourity and its licensors. You may not use, copy, reproduce, or distribute any of our intellectual property without prior written consent.
10. Disclaimer of Warranties
The color analysis results and styling recommendations provided by the App are for informational and entertainment purposes only. They do not constitute guarantees of fit, availability of recommended items, or personal satisfaction. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Colourity, its developers, or its affiliates be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use or inability to use the Service.
12. Termination
We reserve the right, in our sole discretion, to suspend or terminate your account and your access to the Service at any time, without prior notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users or the Service.
13. Changes to Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes are published constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
